Several years back, my client had worked with an older man that developed their website. I've been working with that client for several months and am at the admin stage where we have to begin transferring domains, e-mails, etc...

The former developer had registered the domain until 2009 and we've been trying to track him down for the past couple of weeks to initiate a transfer.

I spoke to the registrar a few moments ago and she shocked the hell outta' me by saying that he passed away about a month ago.

That would explain the full mailbox, no e-mail replies, etc...

It's a sensitive time for his family, I'm sure, so what should I do?

Is there a legal proceeding for us if we provide proof we own the business name, which matches the domain, to initiate a transfer?

His son seems to be a developer too, and I managed to find his phone number, but nobody picks up the phone.

    Any advice?

I spoke to them again. They said he should have access to the EPP code in his admin with them. I need that code to initiate the transfer.

I hope I can track him down.

If he's dead how will you get the code from him. You should ask to speak with a supervisor because all companies have protocol for this situation. It's possible that the lower level rep isn't aware of it.

I'm talking about his son. He's the treasurer of the estate and has the legal power to initiate the transfer. Only problem is, every form of contact I found for him doesn't work.

I'm getting very nervous and am hoping the one e-mail address that didn't bounce back to me makes it to him in the next couple of days and he calls me.

look him up in the white pages. The registrar should also have his contact info if they know he's dead. If not mail it to the father's house and I'm sure they are either picking up mail or are forwarding it.

Hrmm that seems to be a major problem. Best of luck trying to work it out!

Sure sounds like an educational experience. If it works out in the end it may be a neat idea to write a few articles on the subject. I'm sure this isn't an isolated incident. I mean, c'mon, people die all the time, right?

We were extremely lucky to take a step towards resolving the issue today. We managed to convince the registrar to allow us to prove we were the company that matched the domain. After faxing over a bunch of documents, they gave us the login info.

Wil, that's a great idea. Maybe I will write an article on this experience and how to deal with it.
